Terms of Service

1. Agreement to Terms

By accessing jabrr.com, lola-app.jabrr.com, or any jabrr product or service (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.

If you do not agree to these Terms, do not access or use the Services.

2. Description of Services

jabrr LLC provides AI automation software and tools for mortgage industry professionals, including:

• Lola: An AI database reactivation product that contacts dormant leads, scores conversations, and routes qualified prospects to mortgage teams
• jabrr Command Center: An AI-powered operations platform providing voice-first intelligence, pipeline visibility, and team briefings
• Transcriber: AI call transcription and summarization
• Calculator: Mortgage scenario modeling and affordability tools

Services are provided in private beta and may change without notice. Features, availability, and pricing are subject to change.

3. Eligibility

The Services are intended for licensed mortgage professionals, mortgage companies, real estate agents, and related mortgage industry operators in the United States. You must be at least 18 years old and have the legal authority to enter into contracts to use the Services.

4. Pilot Program Terms

jabrr's initial cohort of Lola pilots are provided at no charge under the following conditions:

• Pilot duration is up to 9 days from activation
• Minimum database requirement: 500 active contacts
• Operator must have valid consent for the contacts being enrolled
• In exchange for the free pilot, operator agrees to participate in a post-pilot case study and/or provide a testimonial if results are achieved
• jabrr retains the right to use aggregated, anonymized pilot results in marketing materials
• Pilot spots are limited. Selection is at jabrr's sole discretion.

5. Operator Responsibilities and Compliance

You, as a Lola operator, are solely responsible for:

• Ensuring you have valid consent from all contacts enrolled in Lola outreach, as required by the TCPA, CAN-SPAM Act, and applicable state law
• Maintaining a functioning Do Not Call (DNC) suppression list and honoring all opt-out requests immediately
• Ensuring your use of Lola complies with all applicable federal and state regulations governing AI-assisted communications, debt collection, and mortgage solicitation
• The content of any communications sent through or initiated by Lola on your behalf
• Your own data security and handling of borrower information

jabrr provides the technology infrastructure. Regulatory compliance for use of that technology in your specific operation is your responsibility. We strongly recommend consulting with legal counsel before initiating any outreach campaign.

6. Prohibited Uses

You may not use the Services to:

• Contact individuals without proper legal consent
• Violate any applicable law, regulation, or court order
• Transmit spam, unsolicited communications, or deceptive content
• Reverse engineer, decompile, or attempt to extract source code from jabrr software
• Resell, sublicense, or transfer access to jabrr products without written authorization
• Use the Services in any way that could damage jabrr's reputation or infrastructure

7. Intellectual Property

All intellectual property in the Services — including software, algorithms, designs, trademarks, and content — belongs to jabrr LLC. These Terms do not grant you any ownership rights. You receive a limited, non-exclusive, non-transferable license to use the Services as described herein.

You retain ownership of your data. By using the Services, you grant jabrr a limited license to process your data as necessary to provide the Services.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. JABRR DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED.

jabrr does not guarantee specific business outcomes such as qualified lead counts, conversion rates, or revenue. Pilot results vary by operator, database quality, market conditions, and other factors outside our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JABRR LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, OR LOSS OF DATA — ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising from the Services shall not exceed the fees paid by you to jabrr in the 12 months preceding the claim, or $100 for free services.

10. Indemnification

You agree to indemnify, defend, and hold harmless jabrr LLC and its officers from any claims, liabilities, damages, and expenses (including attorney's fees) arising from: (a) your use of the Services, (b) your violation of these Terms, (c) your violation of any applicable law or regulation, or (d) any claim by a third party arising from your use of Lola or related products.

11. Termination

Either party may terminate access to the Services at any time with or without cause. jabrr may suspend or terminate your access immediately if you violate these Terms, applicable law, or if continuing the relationship poses legal or reputational risk to jabrr.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.

13. Changes to Terms

We may update these Terms at any time. When we do, we will update the "Last Updated" date above. Continued use of the Services after a Terms update constitutes acceptance. We will provide reasonable advance notice of material changes to active operators.
